What Cypress Green's governing documents say
This is an amendment to the governing documents for Cypress Green, a community in Wilmington, NC. It modifies the original Declaration and By-Laws, which apply to all sections of the community. The document is a partial update, not a complete rulebook.
- Developer control: The developer/declarant retains control of the association until 90% of undeveloped property in adjoining sections is sold or until June 30, 2009, whichever comes first. Control must transfer to lot owners no later than 120 days after that event.
- Driveways: All detached single-family residences must have a minimum double-wide concrete driveway.
- Fences, walls, and hedges: No fence, wall, or hedge over 6 feet in height is allowed. Fences must be wood, stained to match the house, and cannot be closer to the front lot line than the front corner of the dwelling. Brick, stucco, chain link, and wire fences are prohibited unless approved by the Architectural Review Committee.
- Maintenance responsibilities: Individual lot owners are responsible for all maintenance and repairs to their lot, including structural and non-structural items. However, the association maintains the front yard of residential lots (mowing and edging for townhomes/condos). Owners are liable for damage to other lots or common elements caused by their failure to maintain.
- Amendment period: The Declaration and By-Laws may be amended by the developer/declarant at any time prior to December 31, 2009.
