What Kerr Farms's governing documents say
Kerr Farms is a single-family home subdivision in Wilmington, NC, governed by a 1957 Declaration of Restrictions that runs with the land. These rules apply to all current and future property owners in Farms 7 and 8.
- Lot & building requirements: Each lot must be at least 16,000 square feet and 115 feet wide at the front setback. Only one detached single-family dwelling (max two stories) plus a private garage (max two cars) and incidental outbuildings are allowed.
- Setbacks & placement: The main building must be at least 50 feet from the front lot line, 12 feet from interior lot lines, and 6 feet from side lot lines. Garages or outbuildings located 75+ feet from the front line may be 6 feet from side lines.
- Minimum dwelling size & cost: Dwellings must cost at least $12,000 (based on 1957 cost levels). Minimum ground floor area is 1,200 sq ft for one-story homes, or 1,000 sq ft for multi-story homes (excluding open porches and garage).
- Prohibited uses & nuisances: No noxious or offensive trade or activity is allowed. No trailer, basement, tent, shack, garage, barn, or temporary structure may be used as a residence.
- Duration & amendment: These covenants run with the land until January 1, 1982, and automatically renew for successive 10-year periods unless a majority of lot owners vote to change them.
- Enforcement: Any property owner in the subdivision may sue to enforce the covenants, seeking to prevent violations or recover damages.
- What this document doesn't cover: This document does not address an HOA, assessments, common areas, architectural review, pets, leasing, parking, or any modern community amenities.
