Division of Ivory Tract is a single-family home subdivision in Wilmington, NC. These restrictive covenants run with the land and bind all current and future owners, tenants, and occupants. The developer retains significant control until all lots are sold, including the power to amend the declaration and approve all construction and exterior changes.
- Architectural review: All new construction, exterior alterations, and painting require prior written approval from the Architectural Control Committee (ACC) or developer. Plans must be submitted; if no decision within 30 days, approval is deemed given. Minimum house size is 1,600 sq ft of heated area. Exterior must be completed within 12 months of starting construction.
- Land use & building type: Lots are for single-family dwellings only, max 2.5 stories. No modular homes, but a mother-in-law suite (500–1,000 sq ft) is allowed. No temporary structures as residences, no trailers or mobile homes. Off-street parking for at least 2 cars required, with paved or approved surfaces.
- Pets: Up to 3 household pets (dogs, cats, etc.) allowed, but not for commercial purposes. Must be leashed or fenced and not a nuisance.
- Vehicles & storage: Boats, RVs, campers, trailers, and similar vehicles must be parked only in the backyard and screened from view. No inoperable or unregistered vehicles in front or on streets. No vehicle repairs visible from street. No motorized off-road vehicles on common areas or undeveloped lots.
- Fences & landscaping: Fences require ACC approval, max 6 ft tall, and cannot be placed forward of the rear corner of the house. Front yard must be sodded before occupancy (or within 6 months with permission). Clotheslines are prohibited. Mailboxes must be uniform design provided by developer.
- Signs & antennas: Only 'For Sale' or 'For Rent' signs up to 6 sq ft allowed on residential lots. Satellite dishes up to 24 inches permitted in rear yard without approval. Other antennas require ACC permission.
- Stormwater & drainage: Each lot has a maximum built-upon area of 5,000 sq ft. Owners must maintain drainage systems and may not alter approved drainage without city consent. A 50-ft vegetative setback must be maintained adjacent to surface waters. Owners are responsible for pro-rata costs of stormwater infrastructure maintenance.
- Road maintenance costs: Each of the 4 lots pays 1/4 of private road maintenance costs. Costs become a lien on the lot and a personal obligation of the owner at the time costs are incurred. Majority of lot owners must approve any road work before costs are shared.
