What Greentree's governing documents say
Greentree is a single-family home subdivision in Wilmington, NC, with covenants that run with the land. The original 1969 restrictions apply to all lots in Section I, but two later documents (2007 and 2011) add separate, property-specific affordability restrictions for two individual lots in Greensboro (not Wilmington). The original Greentree restrictions are the main rulebook for the subdivision.
- What you own & maintain: You own your lot and the house on it. The covenants do not create an HOA or common property; there are no mandatory assessments or shared amenities.
- Residential use only: Lots may be used only for residential purposes. Only one detached single-family dwelling (max 2.5 stories) plus a private garage for up to 2 cars and incidental buildings are allowed.
- Architectural review: Building plans, specifications, and plot plans must be approved in writing for conformity and harmony of external design and location. Approval is by the developer or a committee of lot owners; if no decision within 10 days of submission, approval is deemed given. This requirement expired January 1, 1999, unless renewed by a majority of lot owners.
- Setbacks & building location: Minimum 30 ft from front lot line, 15 ft from side street line, 10 ft from side lot line. No residence may be farther than 60 ft from the front lot line.
- Minimum house size & exterior materials: Dwellings must have at least 1,050 sq ft of heated living area (excluding patios, porches, garages). Exterior must be brick veneer, wood, concrete block, tile, stucco, or concrete and stucco. All structures must be completed on the exterior before occupancy.
- Pets: No more than 6 house pets may be kept on any lot.
- Leasing & rentals: No specific restrictions on leasing or rental terms, except that signs 'For Sale' or 'For Rent' are allowed (max 2 ft x 3 ft, no more than 2 per lot).
- Affordability restrictions (specific lots only): Two separate documents (2007 for 3118 Shallowford Dr, Greensboro; 2011 for 3407 Shallowford Dr, Greensboro) impose owner-occupancy requirements for the life of a HOME program loan. These apply only to those specific lots, not to the entire Greentree subdivision.
