Cottages at Birmingham is a two-unit condominium in Wrightsville Beach, NC. You own your unit and a one-half undivided interest in the common elements. The association maintains the common areas and carries master insurance, funded by assessments on each unit.
- What you own & maintain: You own the interior surfaces and fixtures within your unit's unfinished perimeter walls, floors, and ceilings. You must maintain and repair your unit's interior, including fixtures and utilities. The association maintains all common elements and limited common elements (like decks) except portions allocated to unit owners.
- Leasing & rentals: Rental of the entire unit is allowed, but rental of less than the whole unit is prohibited. No timeshare units are permitted.
- Pets: No animals, livestock, or poultry may be raised or kept. Domestic household pets may be allowed only if permitted by rules approved by all unit owners. Pets must be leashed outside and waste removed immediately. Excessive barking or nuisance may result in removal.
- Parking & vehicles: No campers, trailers, boats, motor homes, or similar vehicles may be parked or stored on the property. Only standard 2-ton pickup trucks or smaller trucks are allowed. No wrecked or junk vehicles, and tools in overnight-parked vehicles must be kept out of sight.
- Architectural review: No building, fence, wall, or other structure may be erected or altered on common or limited common areas without unanimous approval of both unit owners. Exterior color changes require unanimous approval and must match the entire condominium's color scheme.
- Use restrictions & conduct: Units may be used only as a residence by a family, servants, and guests. No use that is a source of annoyance or interferes with peaceful possession is permitted. No burning of wood, leaves, or trash. No laundry hung outside. No trash containers on balconies or screened porches. Barbecue grills may not be stored or used on balconies or screened porches.
- Assessments & fees: Unit owners contribute pro rata based on their percentage undivided interest in common areas. The association sets an annual budget and may collect regular assessments and reserve funds. Late fees (4% of amount due) and interest (10% per annum or max legal rate) apply to delinquent assessments. Unpaid assessments create a lien enforceable by foreclosure.
- Insurance: The association carries property insurance on all common elements (100% replacement value) and liability insurance (at least $1,000,000 per occurrence). Unit owners should maintain their own fire, property, and liability insurance. Unit owner insurance must include a waiver of subrogation against the association and other owners.
