What Colony Green Garden Homes at the Cape's governing documents say
This is a 1997 amendment to the covenants for Colony Green Garden Homes at The Cape, a single-family home subdivision in Wilmington, NC. It replaces the original rules with a new set of restrictions that apply to all lot owners in the community. The document covers land use, construction standards, architectural control, and association assessments.
- Land use & residential only: All lots must be used for residential purposes only. No house trailers, mobile homes, tents, shacks, or temporary structures may be used as residences.
- Minimum home size: One-story homes must be at least 1,200 square feet; homes with more than one story must have at least 1,000 square feet on the first level (exterior finish, excluding porches, steps, garages, etc.).
- Architectural review: An Architectural Control Committee (ACC) appointed by the association's board must approve all building plans, exterior finishes, site plans, and construction schedules before any work begins. The ACC may deny approval for any reason, including aesthetics. If the ACC does not respond within 20 days of a properly submitted plan, it is considered approved.
- Exterior materials & design: Exteriors must be conventional frame, clay brick, stucco, or vinyl. Concrete block, concrete brick, asbestos siding, cinder block, aluminum siding, and composition tar paper are prohibited. Accessory buildings must match the main structure's materials and design.
- Fences & hedges: Fences, walls, or hedges cannot exceed 5 feet in height and must be set back from the front lot line to at least the rear corner of the dwelling. Only wood fences are allowed; wire or chain link is prohibited.
- Pets: Only household pets are allowed. Pets must be kept inside, within an approved fenced area, or on a leash when outside.
- Assessments & association: Every lot owner automatically becomes a member of The Cape Homeowners Association. The association levies annual and special assessments to maintain common areas, private streets, and drainage. Annual assessments can increase up to 10% per year without a vote; larger increases or special assessments require a 2/3 vote of members. Unpaid assessments accrue 10% annual interest and become a lien on the property.
- Golf course easements: Lots adjacent to the golf course are subject to an easement allowing the association to maintain landscaping within 30 feet of the fairway/green boundary. Golfers may enter unimproved portions of a lot to retrieve balls (but not play) after a home is built, and may not use golf carts or linger.
