Bayview Subdivision is a single-family home HOA in Wilmington, NC. These covenants run with the land and bind all lot owners. The rules cover residential use, minimum home size, setbacks, and architectural controls.
- Residential use only: All lots must be used only for residential purposes. No more than one residence per lot.
- Minimum home size: Each residence must have at least 1,650 square feet of heated floor space, excluding porches, garages, and other non-living areas.
- Setbacks & lot lines: Buildings must be at least 15 feet from side boundaries and 50 feet from the front property line (30 feet for lot 12). If two or more lots are combined for one residence, the interior boundary is ignored for setback purposes.
- Temporary structures prohibited: No house trailers, tents, shacks, or temporary structures may be used as residences or placed on any lot.
- Architectural review: The design, color, and exterior materials of all buildings must be approved by the Developer (or its agents). No structures may be moved onto a lot from another location or constructed off-site and moved onto the lot.
- Utilities & screening: Service utilities, fuel tanks, clothes lines, wood piles, and trash must be enclosed within an approved fence or screen. Mail and newspaper boxes must be uniform in design as furnished by the Developer.
- Sewage & wetlands: Sewage disposal must be by septic tank until municipal sewer is available, then connection is required. No construction or earth disturbance in wetlands without Corps of Engineers permits.
- Amendment & duration: These covenants run until June 1, 2008, and automatically extend for successive 10-year periods unless a majority of lot owners vote to change them. Amendments require written consent of the Developer and owners of at least 60% of the lots.
