What Beachside Commons's governing documents say
Beachside Commons is a planned community in North Topsail Beach, NC, governed by a Declaration of Covenants, Conditions, Easements, and Restrictions (CC&Rs). This document establishes the rules for the community, which is still under development by the Declarant (Beachside Commons LLC) and Property Owner (Sneads Ferry Ventures LLC). It applies to all current and future lot owners and their tenants, guests, and invitees.
- What you own & maintain: You own your lot (land and any improvements). The association maintains common elements like Beachside Village Lane, stormwater facilities, and common landscaping. You are responsible for upkeep of your lot, including structures, parking, and landscaping, unless the association assumes it via a supplemental declaration.
- Assessments & fees: Annual assessments are levied on each lot to fund common expenses, calculated based on the lot's maximum built-up area. Special assessments over $2,000 per lot require unanimous board approval. Assessments are a lien on the lot and personal obligation of the owner. Late fees, interest, and collection costs apply.
