The Hammocks at Port Swansboro is a single-family home HOA in North Topsail Beach, NC. This declaration of covenants, conditions, and restrictions (CCRs) binds all lot owners and their tenants. It covers property rights, assessments, architectural control, use restrictions, and insurance requirements.
- What you own & maintain: You own your lot and dwelling; the association maintains common areas, traffic islands, and provides exterior maintenance including lawn care, fence repair, and house washing. Owners are responsible for their own property insurance and interior maintenance.
- Assessments & fees: Annual assessments start at $1,200 per lot, payable monthly, quarterly, or annually. They can increase up to 10% per year without a vote; higher increases require 2/3 approval. Special assessments for capital improvements also need 2/3 approval. Unpaid assessments accrue 10% interest and can become a lien.
- Architectural review: Any exterior changes (buildings, fences, signs, plantings) require written approval from the board or architectural committee. Plans are deemed approved if no decision is made within 30 days of submission.
- Use restrictions: Lots are for single-family residential use only, with buildings no more than three stories. No temporary structures as residences. No livestock or poultry; common household pets allowed if not a nuisance and waste is cleaned up. No outside antennas without approval. Exterior lights must be clear or white.
- Parking & vehicles: Each lot is entitled to at least two parking spaces. Boats, trailers, campers, motor homes, and commercial trucks cannot be parked on the property or adjoining streets unless permitted by rules.
- Leasing & rentals: Leases must be for at least 180 days (six months). Owners may delegate common area use to tenants. No restriction on the right to sell or mortgage.
- Insurance: The association carries property insurance on common elements (at least 80% replacement cost) and liability insurance ($300,000 minimum). Owners must insure their own lots (at least 80% replacement cost) and carry liability coverage. Fidelity bonds are required for those handling association funds.
