Hurst Harbor is a single-family home subdivision in North Topsail Beach, NC, governed by the Hurst Harbor Association (HHA) and the Hurst Harbor North Homeowners Association (HHNHA). These documents are the bylaws and restrictive covenants that apply to all lot owners. The community includes a park and boat launch for residents.
- Land use & building type: Lots are for single-family residential use only. Only one detached single-family dwelling (max 3 stories) per lot, plus a private garage and permitted outbuildings. No trailers, mobile homes, or temporary structures as residences.
- Architectural review: An Architectural Committee (elected from members, not board) must approve plans for construction or alterations. Submit plans; if no response within 30 days, plans are deemed approved. Decisions can be appealed to the Board within 10 days.
- Assessments & fees: Annual assessment is $50 per lot (as of 1997 bylaws), due July 1. Can be increased only by majority vote of members. Special assessments for capital improvements require 2/3 vote. Unpaid assessments accrue 9% interest and become a lien on the property.
- Park & boat launch rules: Park and boat launch are for deeded property owners and their guests (guests must be accompanied). Park hours: sunrise to sunset (boat launch anytime). No overnight parking, camping, or leaving items. No children under 12 unattended. No swimming when boat ramp in use. Park must be locked except when entering/exiting.
- Pets & animals: No livestock or poultry. Dogs, cats, or other household pets are allowed but not for commercial purposes.
- Fences & signs: Fences max 4 feet high; no fence between house front and street unless approved with house plans. Privacy fences up to 7 feet allowed on perimeter adjacent to other developments. No chain-link fences. Signs limited to one 'For Sale'/'For Rent' sign (max 2x2 ft), builder signs during construction, and one 1 sq ft personal sign.
- Parking & vehicles: No vehicle repair on blocks/stands except in enclosed garage. No trailers, campers, or mobile homes parked on lot unless behind the main dwelling or in garage. No trailers left in park after boat launch.
- Lot maintenance & nuisances: Lots must be kept free of rubbish, weeds, and underbrush. Garbage in sanitary containers, not left in front yard except pickup day. No noxious or offensive activities; excessive noise prohibited.
