What Kings Creek's governing documents say
This is a standard single-family HOA in Kings Creek, Holly Ridge, NC. The rules apply to all lot owners and residents. The document also includes an affordable housing deed restriction on one specific lot (559 Goldstaff Ln) that binds the owner/landlord, not residents.
- Land use & building type: Lots are for single-family residential use only. Dwellings cannot exceed 2.5 stories. Minimum ground floor area: 1,000 sq ft for one-story, 700 sq ft for multi-story.
- Setbacks & location: Buildings must be at least 20 ft from front and side street lines, 8 ft from interior side lines, and 15 ft from rear lot line. Corner lots have additional sight-distance restrictions.
- Pets: Household pets (dogs, cats, etc.) are allowed but not for commercial breeding. Pets must be under owner's control and not create a nuisance.
- Fences: Fences over 5 ft are prohibited between the front of the dwelling and the back lot line within 10 ft of any lot line. Fences behind the dwelling must be ornamental (e.g., brick or split-rail).
- Vehicles & temporary structures: No trailers, mobile homes, campers, or inoperable vehicles may be parked on lots unless behind the dwelling or inside a garage. Temporary structures (tents, shacks) are prohibited.
- Stormwater & environmental restrictions: Maximum built-upon area per lot is 3,500 sq ft. A 30-ft vegetated buffer must be maintained between impervious areas and surface waters. Roof drains must terminate at least 30 ft from navigable water. These restrictions cannot be changed without state consent.
- Affordability restriction (Lot 174 only): This lot is subject to a 15-year affordability period. The owner must occupy the residence as their principal residence within 60 days and cannot rent it out. Transfer or refinancing does not end the period. The North Carolina Housing Finance Agency enforces these restrictions.
- What this document doesn't cover: This document does not cover association fees, architectural review process, common area maintenance, or amenities. It is a partial set of covenants and an ancillary deed restriction for one lot.
