The Peninsula at Ocean Isle Beach is a 24-lot single-family home subdivision in Bolivia, NC. These covenants, conditions, and restrictions (CC&Rs) run with the land and bind all current and future lot owners, who automatically become members of the Peninsula at Ocean Isle Beach Property Owners' Association. The rules are designed to preserve the single-family residential character, natural amenities, and property values of the community.
- What you own & maintain: You own your lot and the home on it. You must maintain your lot and structures in a neat, attractive condition; the association maintains the common areas (e.g., roads, walkways, recreational facilities) and can charge assessments for that. If you fail to maintain your lot, the association may step in and bill you.
- Architectural review: No building, fence, wall, landscaping change, or exterior alteration may begin without written approval from the developer (or later the association's Architectural Review Board). Plans are deemed approved if no decision is made within 30 days of complete submission. Approval may be denied on purely aesthetic grounds.
- Residential use & construction: Lots are for single-family residential use only. Only one detached single-family home per lot. At construction start, you must deposit $5,000 with the association (refundable after certificate of occupancy). Maximum built-upon area per lot is 3,000 square feet (including structures, pavement, gravel, etc., but excluding raised open wood decking and pool water surface).
- Leasing & rentals: The document does not restrict leasing or set minimum lease terms. However, any lease must comply with all other covenants (e.g., residential use, no business activity).
- Pets: Only usual household pets are allowed. No breeding or commercial pet keeping. Pets must not create objectionable noise or odor, and must be on a leash or within a fence when outdoors. No livestock or poultry.
- Parking & vehicles: No overnight parking of travel trailers, campers, boats, school buses, trucks, or commercial vehicles on common areas or streets. No stripped, wrecked, or junk vehicles. All vehicles must be currently registered. Golf carts are allowed per town regulations; non-street-legal motorcycles, mini-bikes, and go-karts are prohibited.
- Assessments & fees: Each lot owner pays a one-time entry fee of $250 and quarterly association dues. Special assessments for capital improvements require a 2/3 vote of members. Unpaid assessments accrue 8% annual interest and become a lien on the lot. Non-payment for 30+ days results in loss of pool and recreational amenity access.
- Stormwater & environmental restrictions: Each lot must maintain a 30-foot vegetated buffer between impervious surfaces and surface waters. Roof drains must terminate at least 30 feet from mean high water mark. Filling or piping vegetative conveyances (ditches, swales) is prohibited. These covenants cannot be altered without state approval.
