This is a conservation easement (not a homeowners' association or residential community) recorded by the Town of Oak Island on a 29.15-acre undeveloped parcel adjacent to Lockwood Folly Inlet. It restricts the land to protect water quality and natural habitats; it does not create any residential lots, homes, or community rules for homeowners.
- What this document is: This is a perpetual conservation agreement between the Town of Oak Island and the NC Clean Water Management Trust Fund. It restricts the property to preserve water quality, wildlife, and natural features. It is not a declaration of covenants for a residential subdivision or HOA.
- Allowed uses: Passive recreation (walking, hiking, fishing, swimming, wildlife observation) is allowed. The Town may build unpaved trails, boardwalks, benches, and signs. Native landscaping, invasive plant removal, and dune restoration are permitted if they don't degrade water quality.
- Prohibited activities: No cutting or removal of trees (except for trail maintenance, fire control, or storm damage). No new buildings, mobile homes, antennas, or structures. No industrial, commercial, agricultural, or grazing use. No dumping, excavation, mining, or alteration of wetlands or water flow.
- Signs: Only traffic signs, conservation-identifying signs, educational signs, and similar signs approved by the Fund are allowed. No other signs are permitted.
- Enforcement: The Town of Oak Island is the primary enforcer. If the Town fails to enforce, the NC Clean Water Management Trust Fund (the State) has an independent right to enforce the restrictions.
- Transfer of property: If the Town transfers the land, the new owner must be a qualified conservation organization under IRS Section 170(h)(3). The restrictions run with the land in perpetuity and bind all future owners.
- Public access: This document does not grant the public a right of access to the property. The Town may allow public use, but no public access right is established.
