Harbor Bay is a single-family home subdivision in Bolivia, NC, governed by a homeowners' association (Harbor Bay Property Owners Association). The rules apply to all lot owners and their tenants, guests, and contractors. The community is designed for detached single-family homes only, with strict architectural controls and use restrictions.
- Land use & building type: Lots are for single-family residential use only. Minimum heated floor area is 1,300 square feet. Only site-built homes are allowed; manufactured homes, modular houses, trailers, and mobile homes are prohibited. No temporary structures may be used as residences.
- Architectural review: All site preparation, construction, alterations, and landscaping must be approved in writing by the Architectural Control Committee before work begins. Plans must be submitted with at least two sets of final plans; the committee has 60 days to approve or disapprove. A certificate of final approval is required before occupancy.
- Assessments & fees: Annual assessments are levied on each lot. The initial maximum annual assessment in 2007 was $125 per lot; the board may increase it up to 20% per year without owner vote. Special assessments require 67% owner approval. An initial capital contribution of $125 is due at closing for each lot. Late charges and 18% interest apply to unpaid assessments.
- Vehicles & parking: No stripped, wrecked, or junk vehicles may be parked on lots. All vehicles must have functioning mufflers. Off-road vehicles (ATVs, dirt bikes, 4-wheelers) are prohibited. Motor homes and travel trailers cannot be occupied overnight on any lot.
- Animals: Dogs, cats, and other household pets are allowed but not for commercial purposes. They must be restrained and not allowed to run free. Livestock, poultry, stables, and similar structures are prohibited.
- Nuisances & maintenance: No noxious or offensive activities are allowed. Owners must maintain their property (structures, landscaping, etc.) in good condition. The association may mow lots at least twice a year (by end of May and September) and charge the cost as an assessment if owners fail to do so.
- Leasing & rentals: The document does not specify minimum lease terms or restrictions on rentals. Leases are subject to all governing documents and association rules.
