Finley Farms is a planned community of detached single-family houses in Brunswick County, NC, governed by a homeowners association (HOA). This declaration of covenants, conditions, and restrictions (CC&Rs) applies to all lot owners and residents, covering maintenance, assessments, use restrictions, and architectural control.
- What you own & maintain: You own your lot and dwelling. The HOA maintains common areas (private streets, stormwater facilities, landscaping, mail kiosks) and may also maintain certain items on lots if accepted in writing. You are responsible for all other maintenance on your lot, including utility lines not publicly maintained.
- Assessments & fees: Annual assessments are set by the Board, with a maximum annual increase of 10% over the prior year unless the Board sets a lower amount. Special assessments require approval by 2/3 of Class A Members present and voting. A working capital fee equal to 1/6 of the annual assessment is due at initial sale. Assessments are a lien on the lot if unpaid for 30+ days.
- Leasing & rentals: Leases must be for at least 12 months, in writing, and include a provision binding the tenant to the declaration and HOA rules. Short-term rentals (less than 12 months) are prohibited.
- Pets: A reasonable number of cats, dogs, and other household pets are allowed, but not for commercial purposes. Pets must not become a nuisance, must be leashed outside, and owners must clean up excrement. The Board can require removal of a nuisance animal.
- Parking & vehicles: No abandoned, inoperative, or unregistered vehicles. Boats, trailers, RVs, campers, buses, trucks over 1 ton, and commercial vehicles are prohibited except for temporary stays (max 3 consecutive days). No hazardous cargo vehicles. The HOA may tow violators and levy fines.
- Architectural review: All exterior changes (buildings, fences, signs, walls, major landscaping) require prior written approval from the Declarant (or later the HOA/Architectural Committee). Plans must be submitted; approval is deemed if no response within 30 days. A fee up to $150 may be charged. Chain-link fences are prohibited.
- Use restrictions: Lots are for residential use only. No commercial activity, except sales/leasing by owners and construction activities by Declarant/Builder. No nuisances, outdoor clothes drying, above-ground pools (except small wading pools), window AC units, or sports equipment in streets. Political signs allowed (max 2, 6 sq ft each, 60 days before election, removed within 2 days after).
- Stormwater restrictions: Maximum built-upon area per lot is 4,000 square feet (includes structures, pavement, gravel, etc., but not raised wood decking or pool water surface). Filling or piping vegetative conveyances is prohibited except for driveway crossings. These covenants require state consent to alter.
