What Courtyards by Carrell's governing documents say
Courtyards by Carrell is a planned community in Bolivia, NC, established as an age-restricted (55+) community under the North Carolina Planned Community Act. The declaration creates the CBC Homeowners Association, which governs all lots and common areas, and binds all owners, residents, and guests. The developer retains significant control, including the right to unilaterally amend the governing documents during the Declarant Control Period.
- Age restriction (55+): At least 80% of occupied units must have at least one permanent occupant aged 55 or older. Exceptions allow continued occupancy after death, divorce, or incapacitation of the qualifying occupant. The association conducts annual censuses to enforce compliance.
- What you own & maintain: Owners own their lot and unit (single-family detached dwelling). Owners must maintain the interior, windows, doors, decks, screened porches, HVAC systems, and landscaping within the Courtyard Patio Area. The association maintains unit exteriors (roof, siding, foundations), front porches, and common areas.
- Architectural review: No exterior improvements, alterations, or landscaping changes may be made without prior written approval from the Declarant or its designee (or later the ARC). The reviewer has sole discretion based on aesthetics, and decisions are not subject to review if made in good faith. Approval expires if construction does not start within 6 months or finish within 1 year.
- Leasing & rentals: The association may restrict leasing of multiple lots by the same owner, require a minimum lease term of up to 12 months, and set caps on the number of rental lots. Leases must comply with the governing documents, and tenants are bound by all rules.
- Signs & flags: No signs are permitted except those installed by the Declarant or association, or required by law. Flags of the United States or North Carolina (up to 4x6 feet) may be displayed without a flagpole, in accordance with patriotic customs.
- Assessments & fees: The association levies general, special, and specific assessments on lots. A non-refundable initial contribution is required upon the first purchase of a lot from the Declarant. Assessments constitute a lien on the lot.
- Developer rights & control period: The Declarant (Carrell Homes, LLC) retains the right to unilaterally amend the declaration, add property, and control architectural review until the earlier of: 98% of lots sold, 20 years, or voluntary termination. During this period, the Declarant appoints the board and can veto rule changes.
