Clariday Woods is a single-family home subdivision in Bolivia, NC, governed by a homeowners' association (HOA). This document is the full declaration of covenants, conditions, and restrictions that apply to all lot owners and residents.
- Land use & building type: Lots are for single-family, non-transient residential use only. One dwelling per lot, minimum 1,000 sq ft enclosed area, max 2.5 stories. Manufactured and modular homes allowed if on permanent brick foundation, with composition roof, and less than 3 years old when placed.
- Architectural review: All exterior construction, alterations, landscaping, fences, pools, sheds, and color changes require prior written approval from the Architectural Review Committee (ARC). Plans are deemed approved if no response within 60 days. Declarant and builder have blanket approval during development.
- Leasing & rentals: Leases must have a minimum term of 12 months. Tenants must receive and comply with the declaration and rules. The board may request and approve/deny leases. Owners are responsible for tenant violations.
- Pets: No more than 3 dogs, cats, or common household pets per lot. No commercial breeding. Pets that are dangerous, noisy, or a nuisance must be removed within 10 days of notice. Pets must be leashed outside fenced areas.
- Parking & vehicles: No overnight parking of trailers, RVs, boats, commercial vehicles, or campers on streets or lots except inside a closed garage. Temporary parking allowed for up to 48 hours. Passenger vehicles (including SUVs and light trucks without commercial markings) may park in driveways.
- Assessments & fees: Annual assessments start at $250 per lot, can increase up to 10% per year without member vote. Special assessments may be levied. A $200 working capital fee is due from new owners at closing. Late fees up to 10% of delinquent amount, plus 10% annual interest.
- Signs & antennas: Only one professionally lettered 'For Sale' or 'For Rent' sign (max 4 sq ft, 4 ft high) per lot without ARC approval. Satellite dishes over 1 meter prohibited; smaller dishes must be screened and located in rear, unseen from street.
- Prohibited activities & nuisances: No firearms discharge, hunting, or target practice. No exterior clotheslines. No window AC units visible from front. No above-ground pools. No artificial vegetation or plastic animal decorations. No business activities outside the dwelling.
