What Nature's Walk's governing documents say
Nature's Walk is a single-family home subdivision in Wilmington, NC, governed by a Declaration of Covenants, Conditions and Restrictions (CC&Rs) that run with the land. These rules apply to all lot owners and are enforced by the Nature's Walk Owners Association, which maintains stormwater infrastructure and may levy assessments.
- Residential use & minimum home size: All lots are for single-family residential use only. Each home must have at least 1,800 square feet of heated floor space (excluding porches, garages, etc.), though the developer may approve homes up to 10% smaller.
- Exterior materials & construction: Exteriors must be conventional frame, clay brick, or masonite; stucco, concrete block, vinyl siding, aluminum siding, and similar materials are prohibited. Modular, prefabricated, or previously constructed homes require developer approval.
- Garage & driveway: Each residence must have a garage (attached or detached) sized for at least two cars, built to match the home's exterior, with an asphalt or concrete driveway.
- Setbacks & architectural approval: No fixed setback lines are established; instead, the developer (and later the association) has absolute approval over the location of any structure. All building plans must be approved at least two weeks before construction begins.
- Prohibited structures & uses: No modular homes, mobile homes, tents, temporary structures, above-ground swimming pools, satellite dishes, or advertising signs (except a small 'for sale' sign) are allowed. No boats, large trucks (over 3/4 ton), trailers, motor homes, campers, or loud machinery may be stored on lots. No fuel tanks or storage receptacles may be visible. No noxious or offensive activities, farm animals, or animal sacrifice are permitted.
- Fences & landscaping: Fences or hedges over 3 feet tall require written approval. Fences cannot be placed nearer the front lot line than the rear corners of the house. Lots must be kept mowed and free of unsightly objects; the developer may enter and clean up at the owner's expense.
- Stormwater & environmental restrictions: Maximum built-upon area per lot is 3,795 square feet. A 30-foot vegetated buffer must be maintained between all built-upon areas and surface waters. Roof drains must terminate at least 30 feet from the mean high water mark. Filling or piping of designated swales is prohibited. These covenants cannot be altered without state approval.
- Association & assessments: The Nature's Walk Owners Association maintains stormwater drainage and detention ponds. Annual assessments are set by the Board and can increase up to 10% per year without member vote; larger increases or special assessments require a 2/3 vote. Unpaid assessments bear 1.5% monthly interest and become a lien on the lot.
