What Mclain Heights's governing documents say
McLain Heights is a single-family home subdivision in Wilmington, NC, governed by restrictive covenants recorded in 1973. These rules apply to all lot owners in Section I and are designed to maintain a residential character.
- Land use & building type: All lots must be used for single-family residential purposes only. No more than one residence per lot, and no house trailers, mobile homes, tents, shacks, or temporary structures may be used as a residence.
- Minimum home size: Any residence constructed must have at least 1,400 square feet of living space, excluding porches, steps, walks, breezeways, carports, and garages.
- Setback requirements: No part of any building may be nearer than 10 feet to the side boundary line or 35 feet to the front property line. If an owner uses two or more contiguous lots for one residence, the boundary between them is ignored for setback purposes.
- Signs: No signs or billboards are allowed except private name plates, resident identification signs, and 'For Rent' or 'For Sale' signs, which must not exceed 15 inches by 20 inches.
- Architectural review: The design of all structures must be approved by the Developers or their agent before construction.
- Nuisance & offensive activities: No noxious or offensive trade or activity may be carried on, and nothing may be done that becomes an annoyance or nuisance to the neighborhood.
- Pets: No animals or poultry may be kept except house pets such as dogs and cats.
- Amendments & duration: These covenants run with the land and were originally effective until January 1, 1990, with automatic 10-year extensions unless a majority of lot owners vote to change them. They may also be altered by a written document signed by the Developers and owners of at least 60% of the lots.
