What Harbour Point Yacht Club's governing documents say
Harbour Point Yacht Club is a boat-slip membership community in Wilmington, NC — you own a membership that assigns you a specific boat slip, not real estate. The association maintains the common areas (docks, piers, etc.) and enforces rules for boat and dock use. This document is the declaration of covenants that governs the membership and use of the yacht club facilities.
- What you own & maintain: You own a membership that gives you the right to use a specific boat slip and the common areas. You must maintain your boat in neat, seaworthy condition; the association maintains docks, piers, and other common areas.
- Boat slip use restrictions: Boat slips are for personal, recreational, non-commercial use only. No renting by members (unless declaration is amended). Boat length cannot exceed the slip's footage. No tramp vessels, derelict vessels, barges, or commercial vessels. Boats cannot be used as permanent residences.
- Pets & animals: Animals must be leashed at all times and physically kept on board the boat. They cannot be tied to docks or dock boxes. Owners must clean up pet waste.
- Children on docks: Children under 12 are not permitted on dockways without immediate adult supervision. Running and playing on dockways is not allowed.
- Assessments & fees: Members pay annual, special, insurance, ad valorem tax, and working capital assessments. Annual assessments are based on per-footage of the boat slip. A $150 working capital fee is due upon membership issuance. Assessments are a lien on the membership if unpaid.
- Transfer & membership classes: Class A memberships can be transferred to anyone; Class B memberships are permanently tied to a lot in Harbour Point. Transfers require surrender of the old certificate and issuance of a new one, with a reasonable administrative fee.
- Rules & conduct: No noxious activities, no signs (except developer's), no cooking on docks, no fish cleaning except in designated areas, no unnecessary engine operation, no fishing or swimming from docks, and a dead-slow speed limit. Guests must follow all rules.
- What this document doesn't cover: This document does not cover rules for residential lots or the clubhouse (those are in separate declarations). It also does not specify current assessment amounts, pet limits, or detailed architectural guidelines for docks.
