You own your individual townhome and the lot it sits on, and share ownership of common elements with other owners. The association maintains common areas, carries master insurance, and assesses fees based on your unit's percentage interest.
- What you own & maintain: You own your townhome (interior surfaces, fixtures serving only your unit) and the lot. You must maintain your unit and its limited common elements (e.g., decks, porches, balconies, garage, storage). The association maintains all other common elements, including shared decks, stairways, the swimming pool, and gazebo.
- Leasing & rentals: You may lease your entire townhome for any term, but Access Realty is the exclusive rental agent. Leases must be in writing, and tenants must follow the declaration and rules. Subleases require owner authorization. No lease may allow more occupants than sleeping facilities can accommodate; persons under 18 must be supervised by a parent or guardian.
- Pets: Harmless pets are permitted, but no pets that interfere with peaceful enjoyment. Tenants may not bring pets without the owner's written consent.
- Assessments & fees: Monthly assessments are based on your unit's 12.5% percentage interest (there are 8 equal townhomes). Assessments are due on the first of each month. The association may levy additional assessments if needed. Late fees and fines up to $150 per violation may apply, and unpaid assessments become a lien on your property.
- Use restrictions: Townhomes are for residential use only. No obstruction of common elements, no signs without approval, no activities that increase fire insurance premiums or violate laws. Quiet enjoyment must be respected. Window air conditioners or exhaust fans protruding through windows require board approval.
- Insurance: The association carries master hazard and liability insurance (at least $1M per incident, $2M aggregate). You may carry additional insurance for your personal property and unit. Insurance proceeds for losses over $50,000 are held by an Insurance Trustee.
- Amendments & governance: The declaration can be amended by 75% of townhome owners (and mortgagee approval for certain changes). The executive board initially has 2 members appointed by the declarant, transitioning to 5 elected members after the first two units are sold. Each unit gets one vote.
