This is an amendment to the restrictive covenants of Everetts Creek Estates, a single-family home HOA in Sneads Ferry, NC. It only modifies the lien priority rule for assessments, making the HOA's assessment lien subordinate to first mortgages. The full set of community rules is in the original Declaration of Restrictive and Protective Covenants, not this document.
- Assessment lien priority: The HOA's lien for unpaid assessments is subordinate to any first mortgage. If a lot is sold through foreclosure or deed in lieu of foreclosure, any assessment liens that came due before the sale are extinguished. The new owner is still responsible for assessments that become due after the sale.
