This is a set of restrictive covenants for Indian Springs Subdivision, Section I, a single-family home subdivision in Sneads Ferry, NC. The rules apply to lot owners and cover residential use, building standards, and property maintenance.
- Permitted uses: Lots may be used only for residential purposes. Allowed structures are one detached single-family dwelling, a duplex (two-family), a private garage (may include servant quarters), and appurtenant outbuildings. No temporary structures, trailers, mobile homes, modular homes, or similar relocatable dwellings are permitted.
- Building size & location: Minimum ground floor area: 850 sq ft for a one-story dwelling, 800 sq ft for a multi-story dwelling, and 1,200 sq ft of enclosed heated area for a duplex. Minimum lot width is 60 feet at the setback line; minimum lot area is 15,000 sq ft. Setbacks and building locations must conform to the recorded plat, with a 10-foot rear setback for dwellings and accessory buildings.
- Architectural review: No building, fence, wall, or exterior alteration (including paint color, driveway, mailbox) may be started without written approval from a three-member Architectural Control Committee, chosen by lot owners. Plans must be submitted; if not approved or disapproved within 30 days, approval is deemed given.
- Pets & livestock: No livestock or poultry may be raised or kept. Dogs, cats, or other household pets are allowed but not for commercial purposes.
- Nuisances & maintenance: No noxious or offensive activity is allowed. Weeds and undergrowth must be kept cut; the declarant may enter to cut them but is not obligated. Trash must be kept in sanitary containers.
- Signs: Only one professional sign (max 1 sq ft, parallel to building), one sale/rent sign (max 3 sq ft), and builder signs during construction/sales are allowed.
- Easements & shared features: Easements exist for utilities, drainage, a physical fitness trail, and joint driveways. Party walls (for duplex carports/garages) are governed by shared repair and maintenance costs. Encroachments due to settlement are allowed as long as they exist.
- Term & amendments: Covenants run for 25 years from recording (1984), then auto-renew for 10-year periods unless a majority of owners vote to change. Amendments require 90% of lot owners' consent (or declarant alone if it owns 90%+ of lots).
