Virginia's Landing at Catherines Lake is a townhome subdivision in North Topsail Beach, NC, governed by a homeowners association (HOA). The rules apply to all lot owners and are designed to preserve property values and manage shared infrastructure like stormwater and wastewater systems.
- What you own & maintain: You own your lot and the townhouse on it, including the portion of the roof above your unit. The HOA maintains common areas, private streets, stormwater facilities, and offsite septic systems. You are responsible for maintaining your own dwelling and landscaping, and for sharing costs of party walls and shared roof areas with adjoining owners.
- Architectural review: Any exterior changes—including buildings, fences, landscaping, paint, and yard equipment—must be approved in writing by the HOA's Architectural Committee. Plans are deemed approved if not acted on within 30 days. The committee may deny proposals for any reason, including aesthetics.
- Pets: Household pets are allowed but must not exceed 45 pounds. Prohibited breeds include pit bulls, rottweilers, wolf hybrids, and any dog with a history of aggression. Pets must be leashed off your lot.
- Parking & vehicles: Each owner gets two paved parking spaces near their lot. No vehicles over 5,000 pounds empty weight, buses, or vehicles without current inspection stickers may park overnight. Boats, trailers, and recreational vehicles must be stored out of street view. No vehicle repairs outside an enclosed garage.
- Leasing & rentals: The document does not restrict leasing terms or require HOA approval for rentals. However, all owners must comply with general restrictions (e.g., residential use only, pet limits).
- Assessments & fees: Annual assessments start at $240 per lot for common area and stormwater compliance, plus $60 per lot for nitrification easement maintenance. Assessments can increase up to 15% per year without a vote; larger increases require 2/3 owner approval. Special assessments for capital improvements also require 2/3 approval. A working capital fee equal to two months' assessment is due at initial sale.
- Stormwater & environmental restrictions: Each lot has a maximum built-upon area of 750 square feet. A 50-foot vegetated buffer must be maintained near surface waters. Roof drains must terminate at least 50 feet from surface waters. Altering drainage or filling vegetative conveyances is prohibited without state approval.
