What Nautical's governing documents say
Nautical Wave is a planned single-family home community in North Topsail Beach, NC, governed by a homeowners' association (HOA). This Master Declaration establishes the HOA, sets rules for lot use, architectural review, assessments, and maintenance. It applies to all lot owners, residents, and their guests.
- Land use & building type: Lots are for single-family residential use only. Each dwelling must have at least 2,200 heated square feet (first floor at least 1,200 sq ft). No mobile homes, trailers, or temporary structures as residences. Modular homes allowed with permission.
- Occupancy restrictions: All occupants of a lot must be a single family: related by blood/marriage/adoption/guardianship, or no more than 3 unrelated persons living as a single housekeeping unit.
- Architectural review: All exterior improvements (buildings, fences, landscaping changes) require prior written approval from the Architectural Review Committee (ARC). During the Declarant Control Period, the Declarant controls the ARC. Approval may be based on aesthetic grounds. Plans are deemed approved if no response within 30 days.
- Assessments & fees: Annual assessments start at $15/month per lot, can increase up to 20% yearly without a vote. Special assessments require 2/3 member vote. A one-time initiation fee of $150 per lot is due at sale. Assessments are a lien on the lot.
- Parking & vehicles: Only licensed, operative passenger vehicles may be regularly parked in driveways. No on-street parking except temporarily. Vehicles over 5,000 lbs, campers, boats, and trailers must be stored in an enclosed garage or screened from view. No vehicle repairs outside a garage.
- Pets & animals: No livestock or poultry. Up to 3 dogs/cats combined per lot (more with ARC approval). On lots 3+ acres, up to 2 horses allowed. Pets must be leashed when outside, and owners must clean up after them.
- Fences & structures: Fences over 6 feet are prohibited. No fences allowed between the front of the house and the street. Fences visible from the street must be decorative. Chain link fences are not allowed. All fences require ARC approval.
- Leasing & rentals: Leasing a lot is permitted and is not considered a business. No minimum lease term is stated in this document.
