Soundside Park at Topsail Beach is a mobile home park in Holly Ridge, NC, structured as a joint tenancy where you own an undivided co-ownership interest in the entire 3.43-acre tract and have the exclusive right to use one of 26 spaces for your manufactured home. The community is governed by a homeowners association that maintains common areas, septic, and utilities, and all owners share liability for the property.
- What you own & maintain: You own an undivided 1/26 co-ownership interest in the entire tract, not a separate lot. You have the exclusive right to occupy a specific space for your mobile home. You are responsible for maintaining your mobile home and space, while the association maintains common property (streets, septic, water, electrical systems, piers, boat ramp, landscaping).
- Allowable structures & home age: Only one single-family dwelling per space, which must be a double-wide manufactured home (minimum 24' x 40', 960 sq ft) with a pitched composition roof, brick underpinning, and no hitch/wheels. The home must be no more than 3 years old when placed, and all setup must be completed within 60 days. Existing nonconforming homes may remain until 50% destroyed or removed.
- Leasing & rentals: Leases for more than one year are considered a transfer and must comply with the agreement. The association may prohibit rentals entirely by board rule. Owners are responsible for their tenants' compliance.
- Pets: No animals, livestock, birds, fish, poultry, dogs, cats, or household pets of any kind are allowed on a space except inside a home. No fences or barriers may be built by owners.
- Assessments & fees: Annual maintenance fee was $100 per co-ownership interest initially (amended to $230 in 2001). Fees are payable semiannually in January and July. The board may increase fees after 2003. Special assessments may be levied if funds are insufficient. Delinquent assessments create a lien on the co-ownership interest.
- Use restrictions: Spaces are for single-family residential use only. No business, trade, garage sales, or similar activities are allowed without board approval, though home-based businesses that are not visible or disruptive may be permitted. No temporary structures, trailers, tents, or outbuildings may be used as residences.
- Transfer & ownership rules: You cannot sell or transfer your co-ownership interest unless in compliance with the agreement. Transfers must be reported to the managing agent within 5 days. You cannot further divide your interest, and you waive the right to partition the property. Owners may pledge their interest as loan security.
