Sea Pines is a single-family home subdivision in Bolivia, NC, governed by a 1975 Declaration of Restrictions that runs with the land. The rules apply to all lot owners and are enforced by legal action. A separate 2023 affordability covenant applies to one specific lot (4380 Sweetbay Dr SE) and binds that owner, not the whole community.
- Land use & building type: Lots are for residential use only. Only one detached single-family dwelling (max 2.5 stories), a private garage (may include servant quarters), and appurtenant outbuildings are allowed. Model homes are permitted.
- Minimum dwelling size & quality: The improved lot must have an appraised value of at least $17,000 (based on 1975 cost levels). Ground floor area must be at least 850 sq ft for a one-story dwelling, or 700 sq ft for a multi-story dwelling (excluding open porches and garages).
- Setbacks & lot dimensions: Corner lots: front setback 25 ft (20 ft if fronting the corner), side street setback 20 ft, side lot line setback 8 ft. Interior lots: front setback 35 ft, rear setback 35 ft, garage/accessory setback 10 ft from rear line. Minimum lot width 60 ft at setback line, minimum lot area 12,000 sq ft (except for lots already platted that don't meet these).
- Nuisances & livestock: No noxious or offensive activities. No livestock or poultry; dogs, cats, and other household pets are allowed but not for commercial breeding.
- Building plans & standards: All dwellings must meet or exceed FHA Minimum Property Standards for one- and two-living-units (FHA No. 300).
- Fences & signs: Fences between the front building line and the rear lot line: max 4 ft high, and must be at least 10 ft from any lot line. Fences between the front building line and the street: max 3 ft high. Signs: one professional sign (max 1 sq ft, parallel to building line), one sale/rent sign (max 3 sq ft), and builder signs during construction/sale period.
- Garbage, sight lines, & temporary structures: Trash must be kept in sanitary containers; no dumping. Corner lots: no obstructions between 2 and 6 ft above roadways within 25 ft of street intersections. No temporary structures, trailers, campers, or mobile homes may be used as residences; such vehicles must be parked behind the main dwelling or inside a garage/carport.
- Affordability covenant (Lot 262 only): A 15-year affordability restriction applies to 4380 Sweetbay Dr SE. The owner must occupy the home as their principal residence within 60 days and for the entire period. No renting, no home business use, and no transfer without NCHFA approval. Recapture provisions apply if the home is sold for less than the loan balance.
