Park West at Brunswick Forest is a single-family home neighborhood within the larger Brunswick Forest planned community in Bolivia, NC. This document is the neighborhood's own Declaration of Covenants, Conditions, and Restrictions (CC&Rs), which supplements the master community's rules. It applies to all lot owners, residents, and guests.
- Community structure & master association: Park West is a 'Neighborhood' within Brunswick Forest, subject to a Master Declaration and Master Association. Owners must pay both Park West assessments and Master Association assessments, and comply with all Master Governing Documents.
- What you own & maintain: You own your lot and home. The Association maintains Limited Common Areas (private roads, sidewalks, entrance features, mailbox kiosks, retention structures) and provides routine landscape maintenance for all lots (e.g., mowing, planting care). You are responsible for your lot and improvements beyond that, including replacement of sod, trees, or plantings.
- Assessments & fees: All lots pay equal Base Assessments for common maintenance. Special Assessments over $100/year require majority owner vote (plus Declarant vote during control period). A $250 Working Capital Assessment is due at purchase from Declarant. Builders get a 240-day grace period on assessments. Late payments incur interest, late fees, and potential lien/foreclosure.
- Architectural review: All lots are subject to Park West Architectural Standards adopted by the Master Association's Architectural Review Committee (ARC), in addition to Master Declaration guidelines.
- Declarant rights & control period: Declarant (Funston Land & Timber) holds Class B membership with 3 votes per lot until it owns 5% or fewer lots, or December 31, 2038. During this period, Declarant can amend the Declaration without owner approval (with limits), annex additional property, re-plat lots, and designate Limited Common Areas.
- Enforcement & fines: The Association can fine owners for violations, enter lots to remedy issues (charging owner), suspend services, and file liens for unpaid assessments. Fines and costs become part of the Base Assessment.
