Cypress Pointe Townhomes is a townhome community within the larger Brunswick Forest master-planned community in Bolivia, NC. This document is the Declaration of Covenants, Conditions and Restrictions for the Cypress Pointe Townhomes neighborhood, binding all owners, tenants, and occupants. It establishes a homeowners' association (the Cypress Pointe Townhomes at Brunswick Forest Homeowners' Association) that maintains limited common areas, exterior unit elements, and landscape elements, and it supplements the Brunswick Forest Master Declaration.
- What you own & maintain: You own your townhome unit and the lot it sits on. The association maintains limited common areas (private streets, entrance features, mailbox kiosks, shared irrigation), exterior building surfaces (repainting, roof replacement, gutters), and landscape elements on your lot. You are responsible for interior maintenance, HVAC, walkways, driveways, and any damage caused by your negligence.
- Assessments & fees: All lots pay equal base assessments for common expenses. Special assessments over $100 require approval of half the members and the Class B member (if any). A $250 working capital assessment is due at purchase from Declarant. A $250 mailbox kiosk fee is paid to the Master Association at conveyance. Assessments become liens if unpaid after 30 days.
- Architectural review: The property is subject to architectural design standards adopted by the Master Association's Architectural Review Committee (ARC), in addition to any Cypress Pointe-specific standards.
- Party walls: Walls between units are party walls. Repair and maintenance costs are shared proportionally by the owners who use the wall. Each owner has an easement to enter the adjoining lot for party wall repairs.
- Insurance: The association carries property insurance covering all units and limited common areas (100% replacement cost) and commercial general liability insurance (minimum $1,000,000 per occurrence). Each owner must maintain personal liability insurance of at least $100,000 per occurrence.
- Master community obligations: Cypress Pointe is a neighborhood within Brunswick Forest. Owners must pay Master Association assessments, comply with the Master Declaration and its architectural standards, and the Master Association can veto actions taken by the Cypress Pointe association.
- Amendments & duration: The declaration runs for 20 years from recording (June 2018), auto-renewing for 10-year periods unless 80% of owners vote to terminate. Amendments require 67% owner vote, but Declarant can amend unilaterally until December 31, 2038, for certain purposes.
