This is a townhome community in Olathe, KS, governed by the Kansas Townhome Ownership Act—each owner has a fee-simple lot with a residence, shares common areas (pool, community building, walking trail, etc.) via an undivided interest in the association, and must maintain an H06-type insurance policy. The document is the full amended declaration of covenants, restrictions, assessments, and easements for "The Villas of Asbury" and binds all unit owners, occupants, and their guests.
- Party walls & shared walls: Walls on the dividing line between units are party walls whose reasonable repair and maintenance costs are shared proportionally. The boundary line is the center of the shared wall regardless of the platted line, and no owner may impair structural integrity.
- Leasing & rentals: No lease may be less than one month or for transient/hotel purposes. The entire unit must be leased, the tenant must comply with all governing documents, and the owner must notify the association 30 days before occupancy with tenant name, lease application, and criminal background check. A 5% rental cap applies (with grandfathering for owners who already rented before adoption).
- Pets & animals: No more than four domestic animals per unit. Pit bulls and Dobermans (or other dog types with vicious propensities) are not allowed as residential pets. All pets must be confined to the owner's lot unless on a leash, and owners must immediately clean up after them.
- Exterior appearance & landscaping: No awnings, satellite dishes (without board approval), flags larger than 3x5 feet on a pole no longer than 6 feet, artificial plants, bird baths, lawn art, playhouses, basketball goals, or fences (except written-approved patio fences). Window treatments visible from outside must be neutral (white, beige, or gray). Holiday lights only Nov. 15–Jan. 31; all other exterior lighting must be white.
- Parking & vehicles: Garage doors must stay closed except for vehicle access. Overnight street parking is prohibited on most streets; heavy vehicles (over 8,000 lbs) and recreational vehicles are generally prohibited except when loading/unloading or stored in an enclosed garage. No unlicensed or inoperative vehicles allowed outside the garage.
- Signs: Only standard real estate signs (max 2, 2x4 feet) with correct contact info are allowed on the property. Political signs are prohibited except as required by state law. Other signs require board approval.
- Assessments & reserves: Annual operating assessments are set by the board on an equal-per-unit basis, may increase up to 10% per year without a member vote, and are payable in monthly installments. The board maintains reserve funds for street, painting, and roof replacements. Special assessments for capital improvements exceeding 10% of the yearly budget require 60% of unit owners' approval.
- Maintenance responsibilities: The association handles exterior maintenance: painting, roofs, gutters, landscaping/lawn care, driveways, snow plowing (for private streets and driveways), and common-area utilities. Unit owners are responsible for all interior maintenance, concrete pads, HVAC units, fences, patios, windows, garage doors, pest control, and any upgrades beyond original specs.
