- Covenant enforcement & fines: Violations are reported in writing (with photo if possible). After a first notice, the owner gets two 30-day cure periods (60 days total) before fines start at $25/month per violation. Violations threatening public safety/health have a 72-hour cure period. Maximum fine per violation (including reinspection fees) is $500. Repeat violations can trigger daily $10 fees. After 90 days, the HOA may enter and fix the issue and charge the owner. Voting rights are suspended if the owner has been in violation in the previous 30 days.
- Dues collection & late payments: Assessments are due the 1st of each month. After 30 days delinquent: a $10 late fee and a $5 postcard alert. After that, official notices are sent via certified mail ($10 fee). Every 30 days an additional $10 fee is added. At 90 days: an Intent to Lien notice ($50 fee). At 120 days: a lien is filed ($100 fee). Payments must be in full after that, and the owner pays to release the lien. At 180 days (if over $1,000 owed and no repayment plan): the board may pursue legal action, collection, foreclosure, or wage garnishment. All collection costs are charged to the owner. Voting rights are suspended while an account is delinquent.
- Repayment plans: Owners can set up a repayment plan to spread unpaid dues and fines over up to 18 equal monthly payments. This option is offered in the official delinquency notice.
- Responsibilities of owners who rent: If you rent your home, you are personally liable for any fines or fees caused by your tenants' actions.
