What Parmer Ranch Master Residential Community, Inc.'s governing documents say
This is the master governing document for Parmer Ranch, a large master-planned residential community in Georgetown, Texas. It sets up a two-layer structure: a master association (Parmer Ranch Master Residential Community, Inc.) that oversees the entire development, and separate 'Development Areas' that may have their own additional rules. This document applies to a specific lot or home only after a 'Notice of Applicability' is recorded; until then, no part of the property is subject to this covenant. The document creates a framework for assessments, architectural control, common areas, and voting, but leaves many specifics (like exact fees, pet rules, or lease restrictions) to later documents adopted by the developer or the board.
- Master-planned community structure: This is a two-tier governing system: a master covenant (this document) applies to the entire development once a Notice of Applicability is recorded, and each 'Development Area' within it may have its own separate declaration of covenants, conditions, and restrictions. The master covenant controls common areas, voting, assessments, and architectural review at the community-wide level.
- Property applicability & phasing: No portion of the property described in the covenant is subject to its terms until the developer records a 'Notice of Applicability' for that portion. The developer has no obligation to add any part of the property. The covenant allows the developer to add land, withdraw land, and designate neighborhoods and service areas over a 50-year 'Development Period.'
- Association governance & voting: The association is a Texas nonprofit corporation. Until 75% of the maximum 1,200 lots have been sold to non-developer owners, the developer appoints and removes all board members. Owners of residential lots get one vote per lot. The developer also gets four extra votes for every vote held by others during the Development Period. An optional 'Representative System of Voting' allows neighborhoods to elect delegates to cast their votes.
- Assessments: The association may levy regular assessments, special assessments, special common area assessments, service area assessments, and individual assessments against lots and condominium units. The maximum regular assessment amount and the assessment unit formula are not detailed in this document; they will be set by the board and possibly in a separate assessment schedule. Nonpayment can result in a lien and foreclosure.
- Architectural control & development standards: During the Development Period, the developer (or its designee, the 'Parmer Ranch Reviewer') must approve all improvements, including grading, landscaping, fences, buildings, and other structures, before construction. After the Development Period, an architectural control committee (ACC) appointed by the board takes over. The developer is not obligated to adopt formal design guidelines, but may do so in a separate document.
- Common area & special common area: Every owner has an easement to use common areas (property owned or controlled by the association). 'Special Common Areas' — like private drives, entrance features, or landscaping — may be assigned to specific lots or groups of lots, with those owners exclusively using them and paying their own assessments for maintenance. The developer can designate, modify, or convert these areas during the Development Period.
- Cell towers & telecommunications equipment: The developer has reserved the right to construct, install, and maintain cell towers, antennas, and other telecommunications equipment on common areas or special common areas. Other parties may also hold easements for such equipment.
- What this document doesn't cover: This master covenant does not include specific rules for day-to-day living, such as pet policies, parking, noise, leasing terms, or landscaping standards. Those will be in a separate Community Manual, development area declarations, or rules adopted by the association. It also does not set the actual dollar amount of assessments or provide detailed architectural design guidelines.
