What Mckinney Park East(Austin) Homeowners Association, Inc.'s governing documents say
This is a conditional development agreement between the property owners and a neighborhood association, not a full HOA or condo rulebook. It will only take effect if the City of Austin approves a specific zoning request, and if that approval is not obtained, the entire document is void. The document restricts future use of the land, with limits on building size, parking, and certain business types, but it says nothing about day-to-day life for residents.
- Document status & activation: This covenant only becomes effective if the City of Austin approves the zoning case (C14-2022-0141) in a form acceptable to the owners. If the zoning approval isn't granted or is appealed, the declaration never takes effect.
- Permitted uses & prohibited businesses: Once active, the property cannot include a bail bond office, cocktail lounge, pawn shop, liquor sales (not including a restaurant/bar incidental to a restaurant), outdoor entertainment, or outdoor sound.
- Building size & residential requirement: The base floor-to-area ratio (FAR) is 2:1. To build up to 8:1 FAR, at least 50% of the total square footage must be residential.
- Parking design: Parking must be substantially below grade. A single layer of at-grade parking may be allowed only where needed due to topography, and must be screened from street view and designed to match the below-grade parking. At-grade parking along 12th Street does not require screening.
- Streetscape requirements: The project must provide streetscape improvements along the 12th Street frontage consistent with the City's Great Street Standards, including street trees, benches, and trash receptacles. A schematic design plan must be submitted at the time of site development plan application.
- Enforcement & remedies: Only the property owner (or its successors) and the neighborhood association can enforce these restrictions, not the city or the public. Before suing, the defaulting party gets 30 days to cure after written notice.
- What this document doesn't cover: This declaration does not create a homeowners association, set any rules for residents (pets, renters, noise, parking enforcement, etc.), impose fees or assessments, or restrict occupancy or ownership transfers. It is a single-use covenant tied to a development permit.
