What Figure 8 Beach's governing documents say
Figure 8 Beach is a single-family home subdivision in Wilmington, NC, governed by a Declaration of Restrictions recorded in 1966. The rules apply to residential lot owners and are enforced by the developer (Island Development Company) and later the homeowners' association. The document focuses on architectural control, lot use, and maintenance standards to preserve the community's high aesthetic and environmental quality.
- Architectural review: All building plans, exterior colors, and alterations must be approved in writing by the developer (or its assigns), who may refuse for any reason including aesthetics. Minimum enclosed dwelling area is normally specified in the deed, or defaults to 1,400 square feet. House location is controlled by the developer to maximize views and preserve trees.
- Use restrictions: Lots are for single-family residential use only. Only one detached dwelling (max 2 stories on pilings, 3 on conventional foundation) and one small accessory building (e.g., garage, servant's quarters) are allowed. No temporary structures, trailers, tents, or barns. Guest suites without kitchens may be included but cannot be rented separately.
- Construction timeline: Exterior of all houses must be completed within six months of starting construction, unless delayed by strikes, fires, national emergency, or natural calamity.
- Maintenance and appearance: Owners must keep lots and buildings clean, neat, and unkempt to avoid decreasing neighborhood beauty. No noxious or offensive activities. Garbage must be in screened receptacles, and private garbage collection is required until municipal service is available.
- Assessments: Annual assessments are levied equally on all lots to cover maintenance of bridges, garbage collection, sewage, watchmen, and other common benefits. Separate assessments for street maintenance are apportioned by frontage. Assessments can be terminated by owners of half the lots.
- Environmental protections: No large trees (6+ inches diameter at ground) may be removed without approval unless within 10 feet of a building. Oceanfront lots cannot lower sand dunes below 14 feet above mean low water. No filling of abutting waters. Sewage must go to sewer mains or septic tanks, not into waterways.
- Right of first refusal: If an owner wants to sell, the property must first be offered to the developer at the same price as the highest bona fide offer. The developer has 30 days to match the offer.
- Membership in homeowners' association: Before purchasing, buyers must be approved as members of Figure 8 Beach Homeowners' Association, Inc. and agree to abide by its charter, bylaws, and restrictions.
