Spring Garden is a single-family-attached / townhome homeowners association (HOA) in Raleigh, NC with party walls. This declaration establishes the HOA, common area, assessments, architectural control rules, and use restrictions that run with the land and bind all owners.
- Party wall rules: Walls built on the dividing line between lots are party walls shared by adjacent owners; repair and maintenance costs are split in proportion to each owner's use of the wall.
- Exterior maintenance (townhomes): The association provides and pays for exterior maintenance of each townhome—roofs, gutters, exterior surfaces, trees, shrubs, walks—but not glass surfaces. If damage is caused by the owner's neglect, the repair cost is added to that owner's assessment.
- Assessments & fees: Each lot owner must pay annual assessments (maximum $360/year initially, can increase up to 5%/year without a vote) and special assessments for capital improvements (requires 2/3 vote of each membership class). - Parking & vehicles: Each single-family attached lot or townhome gets use of up to two parking spaces (at least one permanently assigned). Only automobiles may be left overnight in the parking lots; boats and trailers must be parked in a different designated area if the association requires.
- Signs: No signs visible from the public except one 'for sale' or 'for rent' sign no larger than five square feet.
