- Drainage easement purpose: The document creates a perpetual, non-exclusive easement over a 0.21-acre detention pond area and a 1.17-acre open space for drainage, stormwater detention, and related facilities. The easement benefits the subdivision's lots (Tract 95).
- Maintenance responsibilities: The property owner (which includes the association if formed) must keep the detention pond area and drainage facilities in good, safe, working condition as detailed in Exhibit A (monthly/quarterly/after-storm maintenance tasks like debris removal, slope checks, and sediment cleaning).
- Cost sharing: All owners are jointly and severally liable for the costs of maintenance and operation, unless damage is caused by one owner's willful act or gross negligence (then that owner is solely responsible).
