Bolick Park is a standard single-family homeowners association (HOA) in Raleigh, NC. This document is NOT the community's full rulebook. It is a stormwater maintenance covenant required by the City of Raleigh — it creates obligations for the HOA and lot owners to maintain stormwater control facilities, and grants the city inspection and enforcement rights.
- Stormwater facilities & your responsibility: The HOA (Bolick Park Homeowners Association, Inc.) is the designated 'Responsible Party' for maintaining the subdivision's stormwater control facilities (e.g., bioretention basin). All lot owners served by the facilities are jointly and severally liable for maintenance costs. The HOA may levy assessments, and unpaid assessments become a lien on the lot.
- City enforcement & easements: The City of Raleigh holds permanent easements to inspect, access, and, if necessary, repair the stormwater facilities. If the HOA or lot owners fail to maintain them, the city may enter the property, perform the work, and charge the costs back to the affected lot owners, including by assessment and lien.
- Required insurance: The Responsible Party must carry liability insurance of at least $1,000,000 for the stormwater control facilities.
- Penalties for non-compliance: Failure to maintain the stormwater facilities according to the approved manual and Raleigh City Code can result in significant daily civil penalties and other enforcement actions by the city or other governmental authorities.
- What this document doesn't cover: This document is ONLY a stormwater maintenance covenant and protection easement. It does not cover HOA rules on pets, leasing, parking, architectural changes, noise, or any other typical neighborhood restrictions.
