Topsail Reef is a 240-unit condominium community in North Topsail Beach, NC. This document is a 1992 amendment to the condominium declaration, updating legal references and formalizing assessment, voting, and insurance rules. It does not contain the full set of community rules.
- What you own & maintain: You own your individual unit and an undivided interest in the common elements, as shown on Exhibit A. The association maintains the common elements and carries insurance on the full replacement value of the condominium property, including foundations.
- Assessments & fees: Common expenses are assessed per unit based on the fractional interests in Exhibit A. The board may increase assessments up to 10% without member approval; increases above 10% require a two-thirds vote of members present or proxy. Unpaid assessments become a lien.
- Voting rights: Each unit gets one vote, regardless of size or common expense share.
- Insurance: The association must carry casualty/physical damage insurance equal to full replacement value, with a replacement cost endorsement and annual review, and a deductible set by the board.
- Termination of condominium: The condominium can be terminated only by agreement of unit owners holding at least 80% of the votes.
