Bridgewater West II is a planned community of attached single-family townhomes in Holly Springs, NC, governed by a homeowners association (HOA). This declaration binds all lot owners and covers covenants, restrictions, easements, and assessments. It applies to homeowners, buyers, and renters.
- Type of ownership & HOA: You own your lot and townhome; the HOA maintains the common areas (including private streets, sidewalks, landscaping on lots, and exterior maintenance of dwellings as specified). The HOA is run by a board, with the developer controlling it until the Declarant Control Period ends (no later than December 31, 2039, or when all lots are sold to homeowners).
- Assessments & fees: Each lot pays annual assessments set by the HOA board, which can be collected yearly, semi-annually, quarterly, or monthly. Special assessments require approval by two-thirds of Class A members (homeowner votes). A working capital fund equal to one-fourth of the annual assessment is paid at the initial sale. - Pets: Reasonable numbers of cats, dogs, and other household pets are allowed, but not for commercial purposes. Pets must not become a nuisance; the board can require removal. Pets must be leashed outside, and owners must clean up waste. No animals are allowed on common areas except as permitted by rules.
- Parking & vehicles: No parking of abandoned, inoperative, or unregistered vehicles. Boats, trailers, RVs, campers, buses, trucks over one ton, and commercial vehicles are prohibited except for occasional presence (up to 3 consecutive days). Parking on lots and streets is regulated; the association can tow violators at the owner's expense.
- Architectural review: No exterior changes, construction, fences, signs, or major landscaping may be done without written approval from the Declarant (or later the HOA/architectural committee). Plans must be submitted; approval or denial must occur within 30 days. A review fee of up to $150 may be charged. Temporary structures, above-ground pools, and chain-link fences are prohibited.
- Use restrictions & nuisances: All lots are for residential use only; no commercial activity (except by the developer or for showing/selling homes). Nuisances, vehicle repairs in public view, outdoor clotheslines, window AC units, and sports equipment in streets are prohibited. Political signs are allowed (max two, max 6 sq ft each, placed no earlier than 60 days before an election and removed within 2 days after).
