What The Chimneys of Marvin's governing documents say
The Chimneys Of Marvin is a standard single-family-home HOA in Charlotte, NC. This is the full Declaration of Covenants and Restrictions that binds all lot owners. What matters most: every lot is for single-family use only, all exterior changes need prior written approval, and the HOA can assess all owners equally for shared expenses (common areas, amenities like a planned clubhouse and pool, landscaping, insurance, etc.).
- What you own & maintain: You own your home and its lot. The HOA owns and maintains the common elements (open space, green belts, clubhouse, pool, roads, sidewalks, lighting). You must keep your lot and the strip between your lot and the road in neat, attractive condition; if you don't, the HOA can step in, bill you, and place a lien on your property.
- Minimum house size: Any new home built on a lot must have at least 2,350 square feet of interior heated space.
- Architectural review: Before building anything (home, fence, pool, mailbox, even changing exterior paint or roofing), you must submit detailed plans and specs to the HOA board and get written approval. Fences are only allowed behind the house and must use the board's standard 'Approved Fence Details.'
- Use restrictions: Lots are for single-family residential use only – no businesses, no commercial activity. No livestock or poultry; a reasonable number of household pets is allowed but they can't be bred or be a nuisance. No clotheslines, no window air-conditioners, no temporary structures (except during construction). No 'noisy' exterior speakers.
- Parking & vehicles: Boats, trailers, campers, and utility trailers must be stored inside a closed garage. Vehicles must be parked on paved areas and be in operating condition with current tags. No inoperable or unlicensed vehicles.
- Signs & satellite dishes: No signs without board approval, except standard name/address signs and one 'for sale' sign. Satellite dishes are limited to one meter in diameter and must be placed in the least visible location.
- Assessments: The HOA charges annual and special assessments. All lot owners (except the developer) pay an equal share. The board sets the budget each year. Late payments add a late fee, can be accelerated, and become a lien on your home – the HOA can foreclose.
- Leasing & rentals: The document does not set any minimum lease term or restrict rentals further than the single-family use rule. However, the board can adopt additional rules and regulations.
