Maynard Creek is a planned community of detached single-family homes in Cary, NC, governed by the Maynard Creek Homeowners Association. This declaration of covenants, conditions, and restrictions (CC&Rs) establishes the rulebook for all homeowners, residents, and their guests. It covers use restrictions, architectural control, assessments, and maintenance obligations, and applies from the moment you own a lot here.
- Property use & occupancy: Lots are for single-family residential use only (defined as a family or up to three unrelated persons). No commercial activity, no temporary structures used as residences, and no subdivided lots without declarant approval.
- Architectural review: Any exterior change or improvement (fences, landscaping, paint, additions) requires prior written approval from the Architectural Committee. Submissions are deemed approved if the committee fails to act within 60 days of complete application.
- Leasing & rentals: No lot may be leased for less than 30 days. Tenants must comply with all governing documents, and owners are responsible for tenant violations. No for-lease signs visible from neighboring property within 24 months after first sale from developer.
- Pets & animals: Only dogs, cats, and common household pets (types approved by the board) are allowed, in numbers not deemed unreasonable. No breeding, no nuisance animals. Pet enclosures must not be visible from neighboring property.
- Parking & vehicles: No parking in front yards except on driveways. Oversized vehicles (over 18.5 ft long, 6.25 ft high, or 7 ft wide) are largely prohibited unless screened. No inoperable or commercial vehicles visible from neighboring property. Street parking of large vehicles only during daylight and if they cannot fit in the driveway.
- Signs & displays: No signs visible from neighboring property without prior approval, except: one temporary 30x24 for-sale sign, one political sign (max 24x24) displayed 45 days before to 7 days after an election, and developer signs. No political signs earlier or later.
- Architectural standards & landscaping: Owners must install landscaping within 120 days of owning the lot (front yard at minimum; full lot if rear fence is non-solid). All landscaping must be approved in writing. Failure may result in the association installing and billing the owner.
- Assessments & fees: Annual assessments start at $1,440 per lot max (as of 2014) and can increase annually by up to 10% or CPI-linked. Special assessments require 2/3 member vote. Nonpayment leads to late fees, liens, and foreclosure. First purchaser pays two months of assessments into reserves at closing.
