What Park Glen Estates Homeowners Association's governing documents say
This is the corporate bylaws of Park Glen Estates Homeowners Association, Inc., a Kansas not-for-profit corporation that governs a single-family home community in Wichita, Kansas. These bylaws define how the association is organized and run—they cover membership, board structure, meetings, and officer duties—but they do not contain the day-to-day rules that apply to homeowners, such as architecture, landscaping, parking, or pet restrictions. It is only one piece of the governing documents and should be read alongside the Declaration of Covenants, Conditions, and Restrictions.
- Membership & voting: Every owner of a lot is a member of the association and entitled to vote. Voting can be done in person or by written proxy (valid for up to one year unless a longer period is specified). A quorum of at least 20% of lots is required for meetings; most actions are decided by a majority of votes cast.
- Assessments & fees: The board sets annual and special assessments by written resolution, subject to the Declaration. Assessments are the same for all members of the same class, are secured by a continuing lien on the lot, and cannot be waived by non-use of common areas. Owners in default may have voting rights and common-area use suspended for up to 60 days after notice and hearing.
- Board of directors: The board has 1 to 5 members (directors must be members unless appointed by the developer). The developer appoints the initial board; later directors are elected at annual meetings. Directors serve until successors are elected, can be removed for cause by a majority vote or without cause by a two-thirds vote. Meetings must be open to members except for executive sessions covering litigation, contract negotiations, privacy, or attorney consultations; no final action can be taken in executive session.
- Meetings & notice: Annual member meetings are held in the first quarter of each year, with 10 to 60 days' written notice. Special meetings can be called by the board or by members holding at least 10% of the voting power. Board meetings require at least 5 days' notice and can be held by phone or email if all participants can hear or view comments and members are notified.
- Common areas & use rules: The board can adopt rules governing use of common areas and facilities, plus personal conduct of members and guests, and can set penalties for infractions. Common areas are defined by the Declaration and recorded plat.
- Inspection of records: Members may inspect the membership list, books of account, and meeting minutes upon written demand for a purpose reasonably related to their interests, during ordinary business hours. The bylaws and membership list for voting purposes are also available for inspection.
- What this document doesn't cover: These bylaws do not include architectural standards, landscaping rules, parking restrictions, pet policies, rental restrictions, or any other day-to-day homeowner covenants, nor do they set specific assessment amounts, fee schedules, or enforcement procedures beyond general suspension powers. For those rules, you must refer to the Declaration of Covenants, Conditions, and Restrictions and any separate rules adopted by the board.
