Wilshire Farms is a standard single-family homeowners association (HOA) in Overland Park, Kansas. This document is the HOA's governing declaration and bylaws—the rulebook for owners of the 112 lots in the subdivision. It spells out what the HOA maintains, the fees you must pay, and the key rules you'll live by.
- What you own & maintain: You own your lot and the house on it. The HOA is responsible for maintaining all Common Areas (entrance features, landscaping in common tracts, the detention pond, and any pool or right-of-way amenities if developed) and for insuring them. You are personally responsible for maintaining your own lot and improvements; if you don't, the HOA may step in and bill you.
- Assessments & fees: The annual assessment starts at $600 per year per lot (due Jan 1). The board can increase it up to 10% per year for 2006-2008 and up to 5% per year after that without a vote. Members can vote to approve larger increases. There is also a one-time $350 initiation fee due on first occupancy and on each subsequent transfer of ownership. Delinquent assessments accrue a 5% late fee and 10% annual interest, plus a $150 certificate filing fee and full collection costs.
- Special assessments & liens: The board can levy special assessments to cover HOA expenses that exceed available funds, or to correct a specific owner's violation. Unpaid assessments automatically become a lien on your lot. The HOA can suspend your right to use common areas and services (including trash pickup) while you are delinquent.
- Membership & voting: Owners of lots are members. Each lot gets one vote (if multiple owners, they decide how to cast that single vote). Until the developer sells 90% of lots (the 'Turnover Date'), the developer holds most voting power. After turnover, owners control the association. A 20% quorum of votes is needed for member meetings; most decisions require a majority of those present.
- Board of directors: Before turnover, there are 3 directors appointed by the developer. After turnover, there are 7 directors elected by owners for staggered 2-year terms. Directors serve without pay but can be reimbursed for expenses. The board can adopt and enforce rules, levy assessments, hire managers, and maintain insurance.
- Common areas & amenities: Common Areas include entrance monuments, landscaping, the detention pond, and any future pool/clubhouse (called the 'Pool Area') that the developer may choose to build. If built, the pool area transfers to the HOA, which must operate and insure it. Owners release the HOA and developer from liability for pool-related injuries.
- Architectural & use restrictions: The declaration gives the HOA authority to enforce building, use, and aesthetic restrictions—including an Architectural Committee (governed by the declaration)—but specific rules (like paint colors or fence heights) are not detailed here. The board can make and enforce reasonable rules and regulations, levy fines, and take legal action to enforce restrictions.
- Right-of-way amenities & detention pond: The HOA is responsible for maintaining any decorative improvements located in public street rights-of-way (called Right-of-Way Amenities) and the detention pond.
