This is a declaration of restrictions for Greenbrier of Leawood, a single-family home subdivision in Leawood, Kansas. These rules run with the land and bind all owners, not a homeowners association. They control how you may use, build on, and maintain your lot.
- Permitted use: Land may only be used for private, single-family residential purposes. No apartments, flats, businesses, or anything that creates a nuisance. The developer reserves the right to maintain a sales office during development.
- Building size and height: Maximum 2 stories (with developer consent for more). Minimum enclosed floor area: 1,800 sq ft for 1-story homes; 2,400 sq ft (1,600 on first floor) for 1.5-story homes; 2,500 sq ft (1,250 on first floor) for 2-story homes. Certain split-level designs are prohibited.
- Setbacks and projections: Buildings must stay behind front and side building lines shown on the plat, except for limited projections (e.g., windows up to 3 ft, vestibules up to 5 ft). The main body of the residence (including attached garages) cannot occupy more than 80% of the lot's width at the front building line.
- Architectural and site plan approval: No building, remodeling, or exterior alteration (including repainting) without written approval from the developer (and later the Homes Association) for design harmony, location, and finished grade. Required submissions include elevations, site plan, floor plan, exterior materials list, landscape plan, and color schedule. At least 2 weeks' notice for approved alterations.
- Exterior materials and colors: Exterior walls must be brick, stone, wood shingles, wood siding, wood paneling, plate glass, masonite board-and-batt, or stucco. Manufactured stone and lava rock are prohibited. Roofs must be wood shingles, wood shakes, slate, or tile — no asphalt. Windows and doors must be wood or colored metal/plastic. All wood exteriors must be painted or stained.
- Landscaping and lawn maintenance: At construction, lots must be fully sodded or planted with zoysia strips/plugs (except areas designated as natural). Owners must keep lawns uniformly mowed to no more than 4 inches. All areas between residence and adjacent street must be maintained.
- Pets, livestock, and prohibited structures: No livestock or poultry. No solar collectors, above-ground swimming pools, above-ground fuel tanks, or outbuildings without developer consent. No chain-link fences or dog runs. No fence on a corner lot may extend beyond the width of the house.
- Satellite dishes and antennas: Outdoor radio/communication antennas are prohibited without developer consent. Satellite dishes 18 inches or smaller are allowed if concealed from the front of the home (by landscaping or roof placement) and approved in writing by the Homes Association. No dishes larger than 18 inches.
