This document is a non-exclusive permissive use agreement between the Westlake Residences Master Homeowners Association, Inc. and the City of Westlake, Florida. It governs the City's use of the Lodge at the Adventure Park Amenity Center for meetings and events, not resident rights or obligations.
- Who this document is for: This agreement is between the HOA and the City—not residents or homeowners. It authorizes the City to use the Lodge for official meetings and events.
- Permitted use & capacity: The City may use the Lodge solely for City meetings or related events (Council, committees, workshops, etc.) for up to 320 people. The Lodge can be used as a single space or divided into up to 4 smaller rooms.
- Schedule & booking: The City provides an annual calendar of meetings. Additional meetings may be requested at least 5 business days in advance; the HOA responds within 1 business day. The City must confirm configuration at least 36 hours before.
- Fees & payment: The City pays a use fee of $1,000 for the entire Lodge or $500 for a portion per meeting, plus any applicable taxes. Payment is due at least 36 hours before the meeting. Cancellations less than 36 hours before are non-refundable.
- Term & extension: The agreement runs for an initial 5-year term starting March 14, 2028. The City can extend for one additional 5-year term with a 10% fee increase, by giving 90 days' notice. Either party can terminate with 180 days' written notice.
- Rules for use: The City must comply with all laws, the HOA's declaration and rules, and not make alterations without HOA approval. All attendees must use designated parking and enter through the main entrance. The City must leave the Lodge clean and pay for any damages.
- What this document doesn't cover: This agreement does not contain resident rules, restrictions on home use, assessments, pet policies, leasing rules, or any other typical HOA governing documents. It is a facility use contract between the HOA and the City only.
