What Clearview P.u.d. Homeowners Association, Inc.'s governing documents say
This is a set of board-adopted policies and architectural guidelines for Clearview P.U.D. Homeowners Association, a single-family-home community in Eaton, Colorado. It is not the full Declaration of Covenants, Conditions and Restrictions (the actual rulebook); it only covers meeting procedures, conflict-of-interest rules, records inspection, reserve fund investing, assessment collection, fine/enforcement procedures, policy adoption, architectural standards, and miscellaneous lot-maintenance and pet rules. These policies bind all homeowners in the association.
- Architectural review & standards: New construction, exterior alterations, fences, sheds, and landscaping must be approved by the Architectural Control Committee. Minimum home sizes: 1,200 sq ft for one-story, 1,400 sq ft for two-story. Exterior brick must cover at least 25% of front elevation; roof pitch minimum 5:12; 30-year laminated shingles required. Fencing limited to 6 ft height, cedar or white vinyl, with specific thickness and post requirements; no chain link in public view. Sheds limited to 8 ft height and 100 sq ft, must match house colors. Landscaping must be completed within one year of occupancy.
- Enforcement & fines: For covenant violations, the board sends a notice with a correction period; if not corrected, fines may be levied: $100–$5,000 one-time fine, plus $15–$25 per day for continuing violations (up to 120 days). Repeat violations within 12 months may carry up to double the original fine and no hearing right. Owners may request a hearing within 4 days of notice. Fines are collectable as assessments and become a lien on the property.
- Assessment collection & late fees: If assessments are due monthly, a demand letter is sent after two months delinquency; a $100 late fee is charged on any past-due amount. For annual assessments (due March 31), invoices go out in January; past-due accounts incur a $100 late fee on April 15. The association may file liens, sue for personal judgment, and foreclose. Attorney fees and costs are charged to the delinquent owner.
- Lot maintenance: Owners must keep vacant lots free of trash and weeds over 10 inches tall. The association may inspect on the first of each month and arrange work without prior notice. First offense: cost of work only. Second offense: $200 fine plus cost. Third and subsequent: $300 fine plus cost. All charges due within 30 days.
- Pets: Pets must be leashed when off the owner's property. Owners must remove pet waste from all lots, sidewalks, and common areas. Specific pet limits are not stated in these policies (they may be in the Declaration).
