Promontory Pointe is a single-family home HOA in Colorado Springs, CO. This document is a collection of three partial records: the association's articles of incorporation, a set of design guidelines and community standards adopted by the architectural control committee, and a policy on collecting unpaid assessments. The actual binding rules for homeowners are in a separate Declaration of Covenants, Conditions, and Restrictions, so this document does not contain the full rulebook for living in the community.
- Architectural review – when you need approval: You must get written approval from the Architectural Control Committee before starting any exterior improvement, including landscaping, fencing, decks, sheds, paint colors, and play equipment. The committee will review plans within 30 days, and approval is valid for 12 months.
- Fencing – allowed types and rules: Only a specific open-rail, 3-rail wood fence (pressure treated or rough cedar, with 6x6 posts 8 feet apart, top rail 48 inches high) is allowed. Clear sealer with no pigment is required. No painted, chain-link, or double fences. Corner lots must set fencing 4 feet from the sidewalk. Welded wire mesh for pet containment must be on the inside of the fence.
- Landscaping requirements – minimum standards: You must install at least one tree, three shrubs, and three ornamental grasses per 1,000 square feet of landscaped area. Turf (lawn) can cover no more than 33% of that area. An underground irrigation system is required. Front yard landscaping must be completed within 90 days of moving in (excluding November through March).
- Parking & vehicles – what's restricted: No recreational vehicles, trailers, campers, boats, or inoperable vehicles may be parked in driveways, yards, or streets. Overnight street parking is prohibited between 1:00 AM and 6:00 AM. Motorcycles must be stored in the garage when not in use. Basketball goals must be stored near the home daily and not used after 10:00 PM.
- Pets & animal rules: Only ordinary household pets are allowed – no livestock, poultry, or breeding. Dogs and cats must be leashed when off the owner's property. Pet excrement must be collected immediately. Excessive barking is prohibited. Doghouses must match the home's exterior and be no larger than 4x4 feet and 4 feet high.
- Trash collection – mandatory service and rules: The HOA selects a single trash provider for the community; you must use that service and cannot arrange your own. Trash cost is part of your assessment. Containers must be screened from street view and put out only on the morning of collection, then removed after pickup.
- Assessment collection policy – late fees and process: Monthly assessments are due by the 1st of the month. If unpaid after 10 days, they're past due; after 30 days, a $25 late fee and 18% annual interest apply. If still unpaid after 60 days, a second notice and lien filing may occur. After 90 days, the account is turned over to an attorney for collection, and the HOA may suspend your voting rights.
