- Outdoor grills & open flames: Charcoal grills, solid-fuel burners, and other open-flame cooking devices are prohibited on balconies and within 10 feet of any combustible structure (including porches, decks, homes, trees, bushes, or fences). This includes wood, smoked wood chips, pellets, and fire pits. The rule is based on the Colorado Springs Fire Code and affects all condominium and apartment residents.
- Nuisances & fire hazards: No noxious, offensive, or annoying activities are allowed that interfere with residents' peaceful enjoyment. All parts of the project must be kept clean and sanitary, with no accumulation of rubbish or fire hazards. Unit owners cannot permit any use that increases the association's insurance rate.
- Insurance & grill noncompliance: The HOA's insurance policy (Farmers) does not cover charcoal BBQ grills, and the HOA's insurance can be canceled if the fire code rules are not enforced. If that happens, no claims would be paid, and liability for damage or loss would fall on the responsible homeowner.
- Leasing & rentals: Owners who lease their units must provide tenants copies of the Declaration, Bylaws, and Rules and Regulations, and include an addendum in the lease confirming this. Tenants are personally obligated for assessments or other charges arising from their violations or damage to common elements, but the owner remains ultimately responsible. A lease violation by a tenant or occupant is a default under the lease, authorizing the owner to evict.
- Fines & compliance assessments: The Board of Directors may impose monetary fines to deter violations and compel compliance. Additionally, compliance assessments may be levied against a homeowner to reimburse the HOA for costs incurred repairing common area damage caused by the homeowner, their guest, or tenant.
