Carmel Mountain Ranch is a large, multi-phased master-planned community in San Diego governed by a master association (the Carmel Mountain Ranch Residential Community Association). The Bylaws and Declaration you're reading define how the association is run—via an elected board and a delegate voting system—and set out your obligations as a member (homeowner) to pay assessments and follow community rules.
- Governing structure & voting: Homeowners elect Delegates, who in turn represent them and vote on association matters. There are also Sub-Associations within the community. The Board of Directors (5 members) manages daily affairs; some directors must be resident owners. Quorum for Delegate meetings is 51% of voting power; for the Board, a majority of directors.
- Assessments & fees: All owners must pay Common Assessments (monthly, quarterly, or semi-annually as the Board decides) to cover community expenses. The Board can levy Special Assessments and Reimbursement Assessments for violations. Delinquent assessments can be enforced via lien, foreclosure, or suspension of privileges.
- Use of common areas & amenities: Members have easements to use Association Properties (common areas, recreation facilities, etc.). The Board can suspend use privileges for up to 30 days for a non-continuing violation, or longer for ongoing violations (including nonpayment).
- Architectural control: A Master Architectural Committee reviews and approves all exterior improvements, alterations, and landscaping to maintain community standards. Plans and specifications must be submitted for approval before work begins.
- Leasing & rentals: The Bylaws and Declaration do not specify a minimum lease term or restrict rentals beyond requiring all occupants to follow the governing documents. (The excerpted Declaration and Bylaws do not mention lease duration or pet limits.)
- Enforcement & violations: After a written complaint, the Board can impose sanctions (fines, suspension of privileges, notice of noncompliance) following a hearing process. You have 15 days to request a hearing after receiving a complaint.
