Smoketree Henderson Drive is a condominium community in La Mesa, CA — you own your individual unit and a fractional interest in the common areas. The 2012 Amended and Restated Declaration of Covenants, Conditions and Restrictions (CC&Rs) is the full rulebook that binds all unit owners, their tenants, and guests.
- Use & occupancy: Units may be used only as private single-family dwellings. No hotel or transient use — every lease must be for at least 30 days. A unit cannot be rented or leased for its first year after purchase.
- Leasing & rentals: Minimum lease term: 30 days. No rentals allowed in the first year after the owner acquires title. Owners must require tenants to follow all governing documents and give the association tenant contact info.
- Pets: Up to 2 domestic animals under 30 lbs each (mature weight) are allowed, plus caged birds and aquarium fish. Dogs must be leashed on common area and may not be left tethered outside.
- Assessments & fees: Annual dues, special assessments, and individual assessments are levied per unit. Late payments accrue 12% annual interest and a $10 monthly late fee. Assessments become a lien on the unit when recorded.
- Architectural review: Most exterior changes to a unit or common area require prior written approval from the Architectural Review Committee. Submit plans; the committee can charge a review fee. Interior alterations that don’t affect structure or common area don’t need approval.
- Maintenance responsibilities: The association maintains common elements; owners maintain their unit interiors and are responsible for damage they or their guests cause. Owners must immediately report water intrusion and extract water within 24 hours.
- Parking & vehicles: Parking in common area is unassigned and controlled by association rules. Garages and carports must be used for parking vehicles, not storage.
- Voting & governance: One vote per unit. The board of five directors manages the association. Owners can veto certain rule changes. Budget increases over 20% need approval from more than 50% of owners.
